The US regulatory picture on PFAS — per- and polyfluoroalkyl substances, commonly called "forever chemicals" — is moving in two directions at once in 2026. The federal EPA is scaling back standards set by the previous administration, while an accelerating number of states are advancing their own restrictions, many of which directly cover cookware, food packaging, and consumer products.
The divergence has implications for manufacturers and consumers trying to evaluate what PFAS-free claims actually mean for the products they buy or make.
On May 18, 2026, the EPA proposed two rules related to PFAS in drinking water. The first would rescind Biden-era maximum contaminant levels for four specific PFAS compounds — PFHxS, PFNA, HFPO-DA (also known as GenX), and hazard index mixtures. The second would extend compliance deadlines for PFOA and PFOS limits by two additional years, pushing the deadline from 2029 to 2031, according to a timeline published by Harvard Law School's Environmental and Energy Law Program. Public comment periods on both rules close July 20, 2026.
The Plastic Pollution Coalition described the EPA's framing of the move as "a handout to PFAS polluters disguised as public protection." The EPA characterized its approach as a "scientifically sound" strategy. The EPA did announce $1 billion in state funding for PFAS reduction efforts alongside the proposed rollbacks, according to the same source.
The proposed rollback applies specifically to drinking water standards, not to product-level regulations covering cookware, food packaging, or consumer goods. Those remain a separate regulatory track.
Policy analysts at MultiState, a legislative tracking firm, reported that nearly 350 PFAS bills were introduced across 39 US states in 2025, with enacted laws covering cookware, food packaging, textiles, and firefighting foam. The firm's January 2026 analysis noted that as federal regulators loosen PFAS standards, states are expected to fill the regulatory gap.
Several state-level restrictions directly relevant to cookware and drinkware took effect in 2026. Colorado expanded its PFAS bans effective January 1, 2026, adding to existing restrictions on carpets, fabric treatments, food packaging, juvenile products, and cosmetics. Vermont signed legislation in mid-2025 prohibiting the sale of cleaning products, cookware, dental floss, and other consumer goods with intentionally added PFAS. In the EU, France implemented a ban on the manufacture, import, export, and marketing of PFAS-containing cosmetics and wax products effective January 1, 2026. Denmark prohibited the import or sale of PFAS-containing clothing and footwear for private consumers from July 1, 2026. A broader EU REACH restriction covering consumer products across additional sectors is expected to finalize in 2027, according to UL Solutions.
PFAS concerns in drinkware center on two main areas: non-stick coatings on cookware that may contain PTFE or related fluoropolymers, and the presence of PFAS in plastic components — lids, straws, and sealing gaskets — that come into contact with hot beverages.
Ceramic coatings have become a significant category in the shift away from PTFE-based non-stick surfaces. Mamavation, a consumer health publication that has conducted materials investigations into drinkware, took a stated position against nano-ceramic coatings specifically, while noting that standard ceramic coatings are generally considered a safer alternative to fluoropolymer-based non-stick surfaces. The publication also noted that Fellow's Carter Move Travel Mug uses a nano coating inside and PFAS on the outside — the kind of specific disclosure gap that has driven consumer demand for more transparent material labeling.
Green Choice Lifestyle, a non-toxic product review site, noted in a February 2026 assessment that ceramic travel mugs "can be safe if made with certified lead and PFAS-free materials," while cautioning that many ceramics — particularly imported ones or those with colorful, glossy finishes — may contain lead or cadmium in the glaze. The publication also noted it had not found ceramic travel mugs on the market that were both ceramic-lined and reliably certified non-toxic as a category, reflecting the fragmented state of disclosure standards.
Consumer researchers and product reviewers have consistently identified material transparency as the central issue — not whether any specific material is safe by default, but whether manufacturers disclose what their products are actually made of in enough detail for consumers to evaluate independently. Z2Data, a supply chain data firm, noted in a July 2026 analysis that industries are responding to PFAS scrutiny by investing in PFAS-free materials and strengthening supply chain transparency, describing these as increasingly critical capabilities.
Third-party testing and independent lab results, rather than brand claims alone, are increasingly what both consumers and institutional procurement teams are looking for. The question of what "PFAS-free" means is shifting from a label claim to a documentation standard.
The regulatory gap between federal rollback and state-level action is likely to persist through at least 2027. Manufacturers selling into multiple US states face an increasingly complex compliance landscape, with different product categories facing different timelines and exemption structures in different states. The EU's broader REACH restriction process, expected to finalize in 2027, will add another layer of divergence for brands with international distribution.
For consumers, the practical implication in 2026 is that PFAS claims on product labels are not standardized, and what a brand means by "PFAS-free" varies significantly. Independent material testing reports, material disclosure by component, and specific certification details remain more reliable signals than label claims alone.
